Read the essay questions below, and choose one<\/strong> <\/strong>on which to write your final essay. Before writing your essay, you must complete a pr\u00e9cis<\/em> that outlines your arguments. A pr\u00e9cis should be short (1\u20132 pages), but contain the essential points that your paper will cover. Your essay should be 18\u201320 pages long and should incorporate proper citation references when you quote or borrow material from case law or other sources.<\/p>\n

  1. During this course, we have examined feminist legal strategies to affect social change. Write an essay detailing, in your opinion, themost<\/em> <\/em>successful example of this activity. Your example need not be restricted to cases studied in the course, but it must<\/em> <\/em>relate to an issue of women\u2019s rights arising under the Charter<\/em>, and it must demonstrate an adequate understanding of the principles and issues covered here. Explain the issue, the position adopted by Canadian feminist groups and\/or individuals and why you think the strategy was a success.<\/li>\n
  2. Section 15 of theCharter<\/em> <\/em>states that everyone has the right to equality without discrimination on the basis of sex. We have examined cases in which both men and women have alleged sex discrimination with varying degrees of success. Write an essay explaining the appropriate balance between formal and substantive equality in relation to the spirit and purpose of section 15 and the appropriate treatment of sex difference.<\/li>\n
  3. InPlessy v. Ferguson<\/em> (Unit 5), Justice Harlan wrote in dissent, \u201cOur Constitution is colour\u2013blind.\u201d Consider the statement: The Canadian constitution is \u201csex-blind.\u201d Write an essay analyzing the truth of the second statement, with respect to both constitutional text and the purposive approach. Is sex\u2013blindness good? Why or why not? In your essay, be sure to refer to at least three cases.<\/li>\n
  4. One of the themes examined in this course is intra\u2013feminist conflict. In your opinion, which topic has produced the greatest controversy amongfeminists? Describe the nature of the conflict and explain which side appears to have the most support in Canadian law. Provide your<\/em> analysis of the conflict, including what it says about feminist legal theory.<\/li>\n<\/ol>\n
