In particular in such a case the last action of the employer which leads to the employee leaving need not itself be a breach of contract; the question is, does the cumulative series of acts taken together amount to a breach of the implied term?\u2026This is the \u201clast straw\u201d situation.\u2019<\/p>\n<p>(iii) Breach not \u2018waived\u2019 by worker<br \/> Western Excavating Ltd v Sharp [1978] QB 761 (CA), 769 (Lord Denning MR):<\/p>\n<p>\u2018Moreover, he must make up his mind soon after the conduct of which he complains: for, if he continues for any length of time without leaving, he will lose his right to treat himself as discharged.
